Danish national man given suspended prison term for sharing explicit film clips on the social platform Reddit
A Danish man has been found guilty of uploading sexually explicit segments from protected films and TV series on the social media site Reddit.
Based on a police document reviewed by media outlets, the unnamed man posted 347 clips of nude content in a subreddit he moderated, which were then watched 4.2 million times.
The country's police state he has been handed a 7-month deferred jail term for copyright infringement.
Legal analysts explain the man was charged under a seldom-invoked clause in Denmark's copyright law, with the court finding that by removing the footage out of their original context, the accused had damaged the performers' "moral rights".
He has also been found guilty of sharing more than 25 TB of copyrighted digital content.
From spring 2022 to mid-2023, the user using the alias "the pseudonym KlammereFyr" on Reddit posted adult clips featuring over 100 female performers.
He shared them in the forum he was a administrator of.
Per the Danish copyright protection group The Rights Alliance (TRA), his subreddit had more than 6,000 members and participants were prompted to ask for clips of particular actors.
In 2023, campaigners filed the incident to the authorities on behalf of the impacted artists, directors and production companies, which led to the forum being shut down.
One actress, among the performers whose nude content were shared in the community, explained to Danish broadcasters at the time she believed there was a difference between appearing unclothed in a movie and appearing on Reddit.
The performer stated the uploads constituted "exploitation".
'A significant signal'
The man was detained in fall 2024 and pleaded guilty to the allegations recently.
In a statement after the ruling, the head of the Rights Alliance Maria Fredenslund remarked the decision sent an "significant" signal "that infringements of artists' entitlements has repercussions".
The ruling is considered unique in Denmark for its application of the "ethical protections" clause of the national copyright law, which specifies an artist's work cannot be utilized in a way which infringes upon their standing.
Copyright law expert Dr Alina Trapova informed the media the case was "rare" for its focus on the damage to the dignity of an artist, rather than to them financially.
How the ruling could affect nations abroad is uncertain.
But she said there may be "more and more of such cases" in the future with the advancement of artificial intelligence, where "the integrity of one's work might be compromised with greater ease".
