Federal Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling charges, he was detained in immigration custody.
In her decision, the judge noted that the authorities lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The court challenge involve disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in Tennessee.
