Alina Habba has resigned as the US Attorney for New Jersey. This follows a court battle that invalidated her right to serve.

Official Departure

US Attorney General, Pam Bondi, announced the prosecutor's departure on Monday. In a statement that the judicial decision made it "untenable" for her to lead the department effectively.

"But do not mistake adherence to the ruling as defeat," Habba stated. "This battle will now extend throughout America."

Judicial Challenge

The departure comes a week after a US appeals court determined that she had been acting without proper authority as the federal prosecutor. This decision is could influence scores of legal proceedings in the state.

The appellate judges said that a acting appointment that did not receive the advice and consent of the Senate breached the statute on vacant positions.

Ongoing Legal Battle

The Attorney General added that Habba will stay on at the Department of Justice as a top consultant. Habba plans to pursue additional appeals of the court's action, in the hope of achieving a different outcome.

In a statement, the Attorney General argued that the court "should not be able to countermand the executive's selection of prosecutors responsible for executing the executive branch's core responsibility of enforcing the law."

Record and Legacy

Bondi praised her tenure and said that during her run, the state capital of Newark saw a one-fifth decrease in crime. She also stated that the Camden experienced its first summer in 50 years free from homicides.

Background and Previous Role

The 41-year-old attorney, was initially recruited to the former president's legal defense in 2021. Subsequently, she acted for her client in his hush-money trial in 2024, which resulted in his conviction on multiple felony counts of falsifying business records.

Before Habba took on the role of US Attorney, the former president had stated he was naming her as his White House advisor if re-elected, labeling her as deeply loyal and a "tireless advocate for justice".
